Teitei Drive, not legally formed?

David Holland (developer of Snowmass / Alpine Way / Rocky Mountain Chalets) has challenged Ruapehu District Council on their ability to approve any consents for any properties on Teitei Drive due to Teitei Drive possibly being illegally formed.

The Teitei Drive formation connecting to the State Highway is currently encroaching Rochfort Park (Carrot Park), such carriageway "encroachment" is obvious in the attached photo taken from RDC GIS system. OIA requests have received misleading responses, to the point they don't even understand the questions which are clearly asked as follows.

  1. Please provide all the documentation (including copies of RDC Minutes, Public Notices etc) to revoke the current reserve status over the Rochfort Part (in part) where the now public road formation encroaches.

  2. Please provide all documentation (including a copy of the SO Plan, RDC Minutes, Public Notices etc) that the vests the encroaching road carriageway etc as a Public Road

To legally vest part of a reserve as a road requires considerable legal (including advertising, consultation etc) processes, which we don't believe has been done. Until all legal processes are completed then the KO/RDC proposed development is deemed not to have legal formed access. There may accordingly be consequences as to if any resource consents can be sought without this access.
